These Terms and Conditions govern your use of the Discomfort Day mobile application and website (collectively referred to as the “Platform”), operated by Discomfort Day (“we”, “us”, or “our”). By accessing or using the Platform, you agree to comply with these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you may not use the Platform.

1. Use of the Platform

1.1. You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old.

1.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.

1.3. You agree not to use the Platform for any unlawful or prohibited purpose, including but not limited to violating any applicable laws or regulations.

2.1. Users may create and join activities listed on the Platform. Users are responsible for their own participation in activities and acknowledge that participation may involve risks.

2.2. Users agree to abide by any rules or guidelines provided by the activity host and to conduct themselves in a respectful and responsible manner.

2.3. Discomfort Day does not guarantee the accuracy, safety, or quality of activities listed on the Platform and disclaims any liability for damages or injuries arising from participation in activities.

3. User Content

3.1. Users may upload, post, or share content on the Platform, including but not limited to text, photos, and videos (“User Content”).

3.2. By posting User Content on the Platform, you grant Discomfort Day a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content.

3.3. You represent and warrant that you have the necessary rights and permissions to post User Content on the Platform and that such User Content does not infringe any third party rights.

4. Intellectual Property

4.1. The Platform and its original content, features, and functionality are owned by Discomfort Day and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Platform, except as provided herein or with the prior written consent of Discomfort Day.

5. Privacy

5.1. Your use of the Platform is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information.

6. Limitation of Liability

6.1. In no event shall Discomfort Day, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.
